Catch rate

Kyurem's hp is 35% even it is not catched:

it happened with me before several times my friend Viresh and once hp was 25% on capturing shiny and got the message of hp limit
so i got the conclusion that the catch rate 2 b sure of it , there hp has 2 b under pokes hp limits like 24% , 34% , 49% ect.
